1.1. This website www.welcomeapp.org and/or the WelcomeApp application (hereinafter collectively referred to as the "WelcomeApp Platform") are operated by Trust Garant Emlak Ve Ticaret Limited Şirketi. Please carefully read these Terms of Use (hereinafter referred to as "these Terms of Use") before using the WelcomeApp Platform and the services offered by Garant Emlak Ve Ticaret Limited Şirketi, its specific subsidiaries (hereinafter collectively referred to as "WelcomeApp"), or third-party operators (hereinafter referred to as "Operator") through the WelcomeApp Platform (hereinafter referred to as "Services"). The words "you" and "your" as used in these Terms of Use mean (1) any person accessing the WelcomeApp Platform and (2) persons for whom you purchase Services.
- Changes to the Terms of Use
2.1. Changes Made by WelcomeApp
2.1.1. WelcomeApp reserves the right to modify or amend any part of these Terms of Use at any time at its sole discretion without prior notice. You are encouraged to periodically visit this page and review the current Terms of Use, which you have agreed to comply with. If WelcomeApp makes any changes or amendments to these Terms of Use, such changes or amendments will be published in these Terms of Use on this page, and the date of the last revision of these Terms of Use will be indicated at the bottom of this page.
2.1.2. Your continued use of the WelcomeApp Platform after any changes or amendments means that you accept the revised Terms of Use. If you do not agree to comply with the revised Terms of Use, do not continue using the WelcomeApp Platform and/or Services, and do not access the WelcomeApp Platform and/or Services. You are responsible for regularly checking the information on the WelcomeApp Platform to determine if any changes have been made to these Terms of Use and to familiarize yourself with such changes.
- Access and Use of Services
3.1. Ownership of Content
3.1.1. The WelcomeApp Platform, domain name (www.welcomeapp.org), subdomains, features, informational content, and application services (including any mobile application services) periodically offered by WelcomeApp in connection with such applications belong to WelcomeApp, which manages them.
3.2. Provision and Availability of Services
3.2.1. Subject to these Terms of Use, WelcomeApp may offer Services independently or on behalf of Operators, as further detailed on the WelcomeApp Platform. The Services you choose on the WelcomeApp Platform are intended solely for your personal use and not for the benefit of any third party. The term "Services" includes, among other things, the use of the WelcomeApp Platform, any Services offered by WelcomeApp independently or on behalf of Operators on the WelcomeApp Platform. WelcomeApp may modify, suspend, or discontinue the provision of any Services at any time, including access to any feature, database, or informational content. WelcomeApp may also impose restrictions or conditions on certain Services or limit your access to all or any part of the Services without notice or liability.
3.2.2. WelcomeApp does not guarantee that access to the Services will always be available or uninterrupted. WelcomeApp is not responsible to you if, for any reason, the Services are unavailable at a specific time or for a certain period. You are responsible for taking all necessary measures to gain access to the Services. You are also responsible for ensuring that all persons accessing the Services via the internet are aware of these Terms of Use and other applicable terms regarding the Services and comply with them.
3.2.3. If you refer to the WelcomeApp Platform, WelcomeApp, at its discretion, may revoke your right to such a reference at any time. WelcomeApp reserves the right to require prior written consent before establishing a link to the WelcomeApp Platform.
- WelcomeApp Platform and Content
4.1. Use of Content
4.1.1. All materials displayed or used on the WelcomeApp Platform, including but not limited to text, data, graphics, articles, photographs, images, illustrations, videos, audio, and other materials (hereinafter referred to as "Content"), are protected by copyright and/or other intellectual property rights. This WelcomeApp Platform and Content are intended solely for your personal and non-commercial use of the Services and may only be used in accordance with these Terms of Use.
4.1.2. If WelcomeApp agrees to provide you with access to the WelcomeApp Platform and/or Content, such access is provided as a non-exclusive, non-transferable, and limited license to access the WelcomeApp Platform under these Terms of Use. WelcomeApp may, at its sole discretion and at any time without prior notice, modify, remove, or alter the presentation, content, or functionality of all or part of the Content on the WelcomeApp Platform.
4.1.3. You must comply with all copyright notices, trademark instructions, information, and restrictions contained on the WelcomeApp Platform and in the Content accessed through the WelcomeApp Platform. You may not use, copy, reproduce, modify, translate, publish, transmit, distribute, display, license, sell, or otherwise exploit for any purpose the WelcomeApp Platform, Content, third-party materials, or other proprietary rights not belonging to you without the explicit prior written consent of the relevant owners. You also may not use them in any way that violates any third-party rights.
4.2. WelcomeApp's Responsibility Regarding the WelcomeApp Platform and Content
4.2.1. WelcomeApp cannot guarantee the identity verification of any other users you may interact with while using the WelcomeApp Platform. WelcomeApp cannot guarantee the authenticity and accuracy of any informational content, materials, or information provided by other users or Operators. You assume all risks associated with accessing Content through the WelcomeApp Platform and bear sole responsibility for any damage or losses incurred by any party as a result of such access.
4.2.2. Under no circumstances is WelcomeApp liable for any Content, including any errors or omissions in any Content, as well as any losses or damages of any kind incurred in connection with the use or impact of any Content posted, sent via email, used, transmitted, or otherwise made available through the WelcomeApp Platform.
5. Intellectual Property Rights
5.1. Intellectual Property
5.1.1.
All intellectual property rights related to the WelcomeApp Platform belong to WelcomeApp or have been licensed to WelcomeApp for use on the WelcomeApp Platform. The WelcomeApp Platform, Services, and Content are protected by copyright and other intellectual property rights as collective works and/or compilations under applicable copyright laws, international conventions, and other intellectual property protection laws.
You agree to the following obligations:
(a) You are not permitted to, in whole or in part, modify, publish, transmit, participate in the transfer or sale, reproduce, create derivative works, distribute, perform, display, or otherwise use any part of the WelcomeApp Platform and Content, software, materials, or Services;
(b) You may download or copy Content (and other elements displayed on the WelcomeApp Platform or related to the Services) only for personal and non-commercial use, provided that you retain all copyright notices and other notices contained in such Content; and
(c) You must not store any substantial portion of any Content in any form. Copying or storing any Content for purposes other than personal and non-commercial use is strictly prohibited without prior written permission from WelcomeApp or the copyright owner specified in the copyright notice.
6. User Materials
6.1. Information Upload
6.1.1.
When accessing the WelcomeApp Platform or using the Services, you may provide information that may be used by WelcomeApp and/or Operators in connection with the provision of Services and that may be visible to other users of the WelcomeApp Platform. You acknowledge that by posting information or content on the WelcomeApp Platform or otherwise providing content, materials, or information to WelcomeApp and/or Operators in connection with the provision of Services (hereinafter referred to as "User Materials"):
(a) You hereby grant WelcomeApp and Operators a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable right to fully use such User Materials, including all existing applicable intellectual property rights, in connection with the provision of Services, management of the WelcomeApp Platform, and WelcomeApp's business activities, including promoting and distributing part or all of the Services and their derivative products in any media formats and through any media channels;
(b) You agree and authorize WelcomeApp to use your personal data in accordance with the Privacy Policy in effect at any given time;
(c) You hereby grant each user of the WelcomeApp Platform a non-exclusive license to access your User Materials through the WelcomeApp Platform, as well as to use, modify, reproduce, distribute, prepare derivative works, display, and utilize such User Materials as enabled by the functionalities of the WelcomeApp Platform and in accordance with these Terms of Use;
(d) You acknowledge and agree that WelcomeApp reserves the right to reformat, modify, create derivative works, extract portions, and translate any User Materials you submit. For the avoidance of doubt, the foregoing license grant to WelcomeApp does not affect your ownership rights or your right to grant additional non-exclusive licenses to the User Materials unless otherwise agreed in writing;
(e) You hereby represent and warrant that any content in your User Materials (including text, graphics, and photographs) does not violate any applicable laws, regulations, or any third-party rights; and
(f) You bear sole responsibility for all User Materials made publicly available or privately transmitted through the WelcomeApp Platform, and WelcomeApp assumes no responsibility for any errors or omissions in any content.
7. User Representations, Warranties, and Obligations
7.1. Use of the WelcomeApp Platform and Services
7.1.1.
You are responsible for all your actions related to the use of the WelcomeApp Platform and/or Services. Furthermore, you represent, warrant, and undertake to WelcomeApp that you will not:
(a) Engage in any fraudulent, abusive, or otherwise illegal activities that may result in the termination of your right to access or use the WelcomeApp Platform and/or Services;
(b) Post, transmit, or facilitate the posting or transmission of any message or request intended to obtain a password, account, or private information from any other user of the WelcomeApp Platform;
(c) Compromise the security of any computer network, hack passwords or encryption codes, transmit or store illegal materials (including materials that may be deemed threatening or obscene), or participate in any form of illegal activity, which is strictly prohibited;
(d) Use mailing lists, mass emailing, auto-responders, or any other form of spam on the WelcomeApp Platform, or initiate any processes that run or are activated when you are not logged into the WelcomeApp Platform, or otherwise interfere with its proper operation or place excessive load on its infrastructure;
(e) Use manual or automated software, devices, or other processes to scrape, crawl, or bypass any page of the WelcomeApp Platform; or
(f) Decompile, reverse engineer, or otherwise attempt to obtain the source code of the WelcomeApp Platform.
8. Registration and Security
8.1. Creating a WelcomeApp Account
8.1.1.
During the use of the Services, you may be required to create and use an account within the WelcomeApp system (hereinafter referred to as the "WelcomeApp Account").
8.2. Providing Personal Information
8.2.1.
As a condition for using certain aspects of the Services, you may be required to register in the WelcomeApp system and select a password and a username (hereinafter referred to as the "WelcomeApp User Identifier"). If you access the Services through a third-party website or service, WelcomeApp may require that your WelcomeApp User Identifier match your username for such a third-party website or service.
8.2.2.
You must provide WelcomeApp with accurate, complete, and up-to-date registration information. Failure to comply with this requirement constitutes a violation of these Terms of Use and may result in the immediate termination of your WelcomeApp Account.
8.2.3.
You represent that you will not:
(a) Select or use a name as your WelcomeApp User Identifier that belongs to another person with the intent to impersonate that person;
(b) Use a name as your WelcomeApp User Identifier to which another person has rights, unless you have appropriate authorization.
8.2.4.
WelcomeApp reserves the right to refuse registration or terminate a WelcomeApp Account at its sole discretion. You are responsible for maintaining the confidentiality of your password.
9. Reviews, Further Communication, and Rights to User Content
9.1.
By making a booking, you agree to receive confirmation messages (in the form of emails and/or in-app notifications), as well as emails or in-app notifications inviting you to complete our review form after participating in an event.
9.2.
Content provided by users will be considered non-confidential, and WelcomeApp is not obligated to treat such content as confidential information. Without limiting the generality of the foregoing, WelcomeApp reserves the right to use the content at its sole discretion, including deleting, editing, modifying, rejecting, or refusing to publish it.
WelcomeApp is not obligated to offer you any payment for the content you provide or to allow you to edit, delete, or otherwise modify the content after you have submitted it to WelcomeApp. WelcomeApp is not required to credit you as the author of the content and is not obligated to ensure any form of attribution by third parties.

10. Booking Confirmation, Tickets, Vouchers, Fees, and Payment
10.1. Booking Confirmation
10.1.1.
Certain Services are subject to instant confirmation. Except for these Services, any confirmation time indicated on the WelcomeApp Platform is for informational purposes only. The actual time required for confirmation may vary.
10.2. Purchase and Use of Vouchers
10.2.1.
On the WelcomeApp Platform, you may purchase vouchers for Services (hereinafter referred to as "Vouchers") offered by Operators in various locations. In accordance with the respective Operator's policy, you will receive an electronic purchase confirmation, which will include a Voucher confirmation number (hereinafter referred to as the "Confirmation Number") and a printable version of your Voucher.
10.2.2.
To use the Voucher, you must personally and punctually arrive at the meeting point designated by the respective Operator and provide the required documents and/or information, including your Confirmation Number and/or a printed copy of the Voucher. If you fail to arrive on time or do not provide the necessary documents or information, a refund is not guaranteed.
10.2.3.
To use your Voucher, the Operator may also require you to present a valid photo ID. WelcomeApp and the Operator are not responsible for lost, destroyed, or stolen Vouchers or Confirmation Numbers. If the respective Services are prohibited by law, the Vouchers will be voided. If you attempt to use a Voucher in an unlawful manner (e.g., if you are underage and attempt to use a Voucher for wine tasting), the respective Operator may refuse to accept your Voucher, and you will not be entitled to a refund.
10.3. Voucher Usage Terms
10.3.1.
The terms of use for each Voucher may vary depending on the Operator. Any restrictions applicable to a Voucher, including minimum age requirements, will be communicated to you at the time of purchase on the WelcomeApp Platform.
10.3.2.
Vouchers serve as tickets granting access to various events and entertainment activities (hereinafter referred to as "Events"). The Voucher specifies the dates on which it can be used. If a Voucher is not used on the specified dates, except as otherwise stated in its terms, no refund will be issued.
10.4. Voucher Cancellation
10.4.1.
You may cancel your Voucher by contacting WelcomeApp customer support within the cancellation period specified at the time of purchase on the WelcomeApp Platform. Cancellation periods vary depending on the specific case. The cost of a canceled Voucher, upon submission of the required cancellation notice, will be fully refunded to the credit card used for the purchase.
10.4.2.
The service provider for the Events associated with the Vouchers is not WelcomeApp but the respective Operator, who holds exclusive responsibility for accepting or rejecting any Voucher you have purchased for such Services.
10.4.3.
If you have any questions or complaints regarding the Service received through your Voucher, you should contact the Operator directly. Except as otherwise stated herein, all amounts paid for Vouchers are non-refundable. The prices listed for Vouchers are displayed in the currency specified on the WelcomeApp Platform at the time of purchase.
10.4.4.
If the Operator cancels the Event for which you purchased a Voucher, WelcomeApp will notify you as soon as possible and provide a full refund to the credit card used for the purchase of that Voucher.
10.5. How to Request Assistance
10.5.1.
If you attempt to use a Voucher in accordance with these Terms of Use and any additional terms applicable to that Voucher but are unable to do so (due to the Operator's fault or another reason), please contact WelcomeApp at [email protected], and WelcomeApp will attempt to contact the Operator to take appropriate action.
10.6. Additional Fees
10.6.1.
WelcomeApp reserves the right to charge fees or payments for any Services offered by WelcomeApp. You must pay all applicable fees or payments related to the Services you select, as described on the WelcomeApp Platform.
10.7. Pricing Changes
10.7.1.
WelcomeApp reserves the right to modify its pricing list for fees or payments at any time after publishing a notice, which may be sent to you via email or posted on the WelcomeApp Platform. Your continued use of the Services offered by WelcomeApp after receiving such notice constitutes your acceptance of any new or revised fees or payments.
10.8. WelcomeApp Rights and Responsibilities
10.8.1.
WelcomeApp reserves the right to refuse and cancel any booking or purchase of Services deemed to be in violation of this policy. Such determinations remain at the sole discretion of WelcomeApp.
10.8.2.
WelcomeApp aims to offer you Services or facilitate their provision by Operators at the most competitive price available on the market. You acknowledge and agree that in determining the most competitive price, all applicable taxes and additional fees for specific Services that are subject to payment for using the Services are expressly excluded.
10.8.3.
Although Operators are required to provide WelcomeApp with accurate and up-to-date pricing for Services on the WelcomeApp Platform, WelcomeApp cannot guarantee that all prices for Services provided by Operators will always be accurate and up to date.
10.9. Global Applicability
10.9.1.
The above terms and refund policy apply to all WelcomeApp users worldwide.
11. Indemnification and Liability Release
11.1. Indemnification of WelcomeApp
11.1.1.
You agree to indemnify and hold harmless WelcomeApp, our holding companies, subsidiaries, affiliates, officers, directors, and employees from any losses, liabilities, settlements, costs, attorneys' fees, claims, or demands made by any third party as a result of your access to the WelcomeApp Platform, use of the WelcomeApp Platform, violation of these Terms of Use, or infringement of any intellectual property or other rights of any individual or legal entity by you or any third party using your WelcomeApp User Identifier.
11.2. WelcomeApp’s Involvement in Legal Defense
11.2.1.
WelcomeApp may, at its discretion, participate in the defense of any claim or legal dispute and in any settlement negotiations. You may not enter into any agreements that may negatively affect the rights or obligations of WelcomeApp without prior written consent from WelcomeApp. WelcomeApp reserves the right, at its own expense and upon notification, to assume exclusive defense and control of any claims or legal proceedings.
12. Disclaimer of Warranties and Limitation of Liability
12.1. Relationship Between Parties
12.1.1.
WelcomeApp does not establish any special relationship or fiduciary obligation with you regarding access to and use of the WelcomeApp Platform and Content. You agree that WelcomeApp does not control and is not obligated to take any action regarding:
(a) which users access the WelcomeApp Platform;
(b) what content you access through the WelcomeApp Platform;
(c) how the Content may affect you;
(d) how you may interpret or use the Content; and
(e) what actions you may take based on the Content.
12.2. Services and Recommendations
12.2.1.
You acknowledge and agree that Operators may offer Services on the WelcomeApp Platform and that Operators or WelcomeApp users may provide suggestions or recommendations. WelcomeApp makes no representations or warranties regarding the accuracy of any Service descriptions or the validity of any suggestions or recommendations related to Services that can be obtained or purchased through the WelcomeApp Platform.
12.3. Liability Release
12.3.1.
Under no circumstances shall WelcomeApp, the WelcomeApp Platform, or any of its holding companies, subsidiaries, affiliates, officers, directors, and/or employees be liable for lost profits, or any indirect, incidental, special, punitive, or consequential damages arising in connection with:
(a) the WelcomeApp Platform;
(b) these Terms of Use;
(c) any breach of these Terms of Use by you or a third party;
(d) the use of the WelcomeApp Platform, tools, or Services provided by us in connection with your activities or the activities of third parties we facilitate on the WelcomeApp Platform; or
(e) any actual or attempted interactions or transactions between users, even if we have been informed of the possibility of such damages.
12.3.2.
These limitations and exclusions apply regardless of whether damages arise from:
(a) breach of contract;
(b) breach of warranty;
(c) strict liability;
(d) tort;
(e) negligence; or
(f) any other legal cause, to the maximum extent permitted by applicable law.
12.3.3.
The WelcomeApp Platform, including all content, software, functions, materials, and information available on or accessed through the WelcomeApp Platform, is provided "as is." To the fullest extent permitted by law, WelcomeApp makes no representations or warranties, whether express or implied, including but not limited to:
- the accuracy of information on the WelcomeApp Platform,
- the materials, information, and features accessible through the WelcomeApp Platform,
- any Services or hyperlinks to third parties,
- any security breaches related to the transmission of confidential information through the WelcomeApp Platform, or
- the reliability, merchantability, fitness for a particular purpose, or uninterrupted and error-free operation of the Services.
12.3.4.
You acknowledge and agree that any communications sent to and from the WelcomeApp Platform are not confidential and that your messages may be read or intercepted by others. You also acknowledge and agree that sending messages to WelcomeApp or posting information on the WelcomeApp Platform, including about tours and/or events, does not create any confidential, fiduciary, contractual, or other relationship between you and WelcomeApp, except as expressly set forth in these Terms of Use.
12.3.5.
You acknowledge and agree that you will not hold WelcomeApp liable for content provided by any Operator or third party. You also acknowledge and agree that WelcomeApp is not a party to any transactions related to Services provided by any Operator or third party. WelcomeApp does not control and does not guarantee the safety of any transactions, tours, and/or events or the accuracy or reliability of any listings or other content provided by any Operator or third party on the WelcomeApp Platform.
12.4. Legal Remedies
12.4.1.
If you are dissatisfied with the WelcomeApp Platform, disagree with any part of these Terms of Use, or have any other claims against WelcomeApp or another user of the WelcomeApp Platform regarding these Terms of Use or the WelcomeApp Platform, your sole and exclusive remedy is to stop using the WelcomeApp Platform.
12.4.2.
To the extent permitted by applicable law, WelcomeApp's liability and the liability of any WelcomeApp-affiliated entity to you or any third party arising from the use of or in connection with the WelcomeApp Platform is limited to the greater of:
(a) the amount you paid to WelcomeApp in the twelve months preceding the event giving rise to liability; or
(b) $50.00 USD in total for all claims.
13. Interaction with Third Parties
13.1. Third-Party Links
13.1.1.
The WelcomeApp Platform may contain links to third-party websites or services ("Third-Party Sites") that are not owned or controlled by WelcomeApp, or Services may be accessed through a Third-Party Site. The presence of links to Third-Party Sites does not imply that WelcomeApp endorses or recommends such sites or the information, products, advertisements, or other materials available on them.
13.1.2.
Accessing Third-Party Sites is at your own risk. You represent and warrant that you have read and agree to comply with all applicable rules of any Third-Party Sites regarding your use of Services and that you will comply with those rules in addition to your obligations under these Terms of Use.
13.1.3.
WelcomeApp does not control and is not responsible for the content, accuracy, privacy policies, practices, or opinions expressed on any Third-Party Sites. Furthermore, WelcomeApp does not monitor, review, censor, or edit the content of any Third-Party Site. By using the Services, you release WelcomeApp from any liability arising from your use of any Third-Party Site.
13.1.4.
Your interactions with organizations and/or individuals contacted through or via the Services, including Operators, such as payment and delivery of goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such organizations and/or individuals.
13.1.5.
You should conduct any investigation you deem necessary or appropriate before engaging in any online or offline transactions with any of these third parties.
13.2. WelcomeApp’s Liability
13.2.1.
You agree that WelcomeApp is not responsible for any loss or damage incurred as a result of such transactions. If a dispute arises between users of this site or between users and any third party, you agree that WelcomeApp has no obligation to become involved. In case of a dispute with one or more users or third parties, you hereby release WelcomeApp, its holding companies, subsidiaries, officers, directors, employees, agents, and successors from any claims, demands, and damages (actual and consequential) of any kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way related to such disputes.
14. Termination of Access
14.1. Termination by WelcomeApp
14.1.1.
These Terms of Use remain in effect while you use the WelcomeApp Platform or Services. WelcomeApp may terminate or suspend your access to the Services or membership at any time, for any reason, and without prior notice. This may result in the confiscation and deletion of all information related to your participation. WelcomeApp may also terminate or suspend all Services and access to the WelcomeApp Platform immediately, without prior notice or liability, if you violate any provision of these Terms of Use.
14.2. Consequences of Termination
14.2.1.
Upon termination of your WelcomeApp Account, your right to use the Services, access the WelcomeApp Platform, and any Content immediately ceases. All provisions of these Terms of Use that, by their nature, should survive termination will remain in effect after termination, including provisions related to ownership rights, warranty disclaimers, and limitations of liability.
14.2.2.
If these Terms of Use are terminated due to a violation on your part, WelcomeApp reserves the right to cancel any Vouchers you may have purchased before the termination date, without refund or liability to you.
15. Miscellaneous Provisions
15.1. Severability
15.1.1.
If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or removed to the minimum extent necessary for the remaining Terms of Use to remain in full force and effect and legally enforceable.
15.2. Assignment of Rights
15.2.1.
These Terms of Use may not be assigned, transferred, or sublicensed by you without prior written consent from WelcomeApp. WelcomeApp may assign, transfer, or delegate these Terms of Use, including its rights and obligations, without prior notice.
15.3. Language
15.3.1.
These Terms of Use are drafted in English, and the English version shall be used for interpretation. Any translation of the Terms of Use is for informational purposes only. In case of any discrepancies between the English version and a translation, the English version shall prevail.
